By accessing or using MindFold ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Description of Service

MindFold is a personal journaling application that uses artificial intelligence to provide insights, reflections, and mental health metrics based on your journal entries. The Service is designed to support personal reflection and self-awareness.

4. User Accounts

• You must be at least 13 years old (or 16 in the EU) to use the Service
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You agree to provide accurate and complete information when creating an account
• You must notify us immediately of any unauthorized use of your account

5. User Content

You retain ownership of all content you create through the Service, including journal entries. By using the Service, you grant us a limited license to process your content for the purpose of providing the Service (e.g., AI analysis, storage, display).

You are solely responsible for your content and agree not to submit content that:

• Violates any applicable law or regulation
• Infringes on the rights of any third party
• Contains malicious code or attempts to compromise the Service

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service

The Service, including its design, features, and content (excluding user content), is owned by MindFold and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express permission.

8. AI-Generated Content

The Service uses artificial intelligence to generate insights, reflections, and metrics. You acknowledge that:

• AI-generated content may not always be accurate or appropriate
• AI responses are based on patterns and algorithms, not human judgment
• You should not rely solely on AI-generated content for important decisions
• We are not responsible for how you interpret or use AI-generated content

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDFOLD AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Personal injury or emotional distress
• Any decisions made based on the Service's content or AI-generated insights
• Interruption of service or loss of access
• Any actions you take or fail to take based on the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

11. Indemnification

You agree to indemnify, defend, and hold harmless MindFold and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service, your content, or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time through the account settings.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MindFold operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MindFold regarding the Service and supersede all prior agreements and understandings.
